1. INTRODUCTION AND ACCEPTANCE

Welcome to 1UP Esports. These Terms of Use ("Terms") govern your access to and use of the 1UP Esports website, services, applications, and tournaments (collectively, the "Platform").

By accessing, registering for, or using our Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use our Platform. We reserve the right to refuse service to anyone for any reason at any time.

2. DEFINITIONS

• ✓Site/Platform: The 1UP Esports website, mobile applications, and related digital infrastructure.
• ✓Services: All features, tournaments, matchmaking, and content provided by 1UP Esports.
• ✓User: Any individual who accesses or uses the Platform.
• ✓Account: A registered user profile created on the Platform.
• ✓Content: Text, graphics, images, music, software, audio, video, and other materials available on the Platform.
• ✓Tournament: Any competitive gaming event organised, hosted, or sponsored by 1UP Esports.
• ✓Prize: Any monetary reward, physical item, or digital asset awarded to Tournament winners.
• ✓Intellectual Property: Trademarks, copyrights, patents, trade secrets, and other proprietary rights.

3. USE LICENCE AND RESTRICTIONS

1UP Esports grants you a limited, non-exclusive, non-transferable, and revocable licence to access and use the Platform for your personal, non-commercial use, subject to these Terms.

You are strictly prohibited from:

• ✓Engaging in illegal activities or promoting unlawful acts.
• ✓Harassing, threatening, or abusing other Users.
• ✓Cheating, exploiting bugs, or using unauthorised third-party software.
• ✓Sharing your Account or accessing another User's Account.
• ✓Reverse engineering, decompiling, or disassembling any part of the Platform.
• ✓Scraping, data mining, or using automated means to extract data.
• ✓Distributing spam, malware, or malicious code.
• ✓Impersonating 1UP Esports staff or other Users.
• ✓Violating Intellectual Property rights or circumventing security measures.

Violation of these restrictions may result in immediate suspension or termination of your Account and access to the Platform.

4. USER ACCOUNTS AND REGISTRATION

To participate in Tournaments and access certain features, you must register for an Account. You must be at least 13 years old to create an Account. Users under 18 require parental or guardian consent to participate in Tournaments with cash Prizes.

You agree to provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your password and for all activities that occur under your Account. You must notify us immediately of any unauthorised access.

You are permitted to maintain only one (1) Account per person. We reserve the right to terminate duplicate Accounts or Accounts providing false information.

5. USER CONDUCT AND BEHAVIOUR

1UP Esports is committed to maintaining a fair, respectful, and competitive environment. Users must conduct themselves with sportsmanship and civility at all times.

We strictly prohibit hate speech, discrimination, harassment, toxicity, and any form of cheating or doping (including the use of performance-enhancing drugs in live events).

Misconduct may result in warnings, match forfeitures, Tournament disqualification, temporary suspension, or permanent termination of your Account. We reserve the right to investigate alleged misconduct, review chat logs, and remove offending content or ban Users at our sole discretion.

6. INTELLECTUAL PROPERTY RIGHTS

All content, design, logos, trademarks, and infrastructure on the Platform are the exclusive property of 1UP Esports or its licensors and are protected by copyright and intellectual property laws.

By submitting User-Generated Content (UGC) to the Platform, you grant 1UP Esports a worldwide, royalty-free licence to use, display, and distribute that content in connection with our Services. You retain ownership of your UGC.

You may not reproduce, modify, or distribute our Intellectual Property without explicit written consent. We comply with the Digital Millennium Copyright Act (DMCA) and respect third-party IP rights.

7. TOURNAMENT RULES AND PARTICIPATION

Participation in Tournaments is subject to specific rulesets provided for each event. By entering a Tournament, you agree to comply with its specific rules, eligibility requirements, and schedule deadlines.

• ✓Eligibility: You must meet age, geographic, and platform requirements specified for the Tournament.
• ✓Equipment: You are responsible for providing your own compatible hardware, software, and stable internet connection.
• ✓Prizes: Prize distribution is subject to verification. You are solely responsible for any taxes associated with Prize winnings.
• ✓Disqualification: Cheating, collusion, or rule violations will result in immediate disqualification and potential forfeiture of Prizes.
• ✓Broadcasting: 1UP Esports reserves the right to stream, broadcast, and record any Tournament matches.

1UP Esports reserves the right to modify Tournament rules, resolve disputes, and enforce anti-cheating measures at its sole discretion to ensure fair play.

8. USER-GENERATED CONTENT

You are solely responsible for any content you post, upload, or transmit through the Platform. You warrant that your UGC does not infringe on any third-party rights or violate any laws.

We prohibit the posting of illegal, harmful, offensive, or explicit content. While we have no obligation to moderate UGC, we reserve the right to remove any content that violates these Terms and to implement moderation policies as we see fit. You agree to indemnify 1UP Esports against any claims arising from your UGC.

9. LIMITATION OF LIABILITY

The Platform and Services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including warranties of merchantability or fitness for a particular purpose.

To the maximum extent permitted by law, 1UP Esports shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising from your use of the Platform.

We assume no liability for third-party content, service interruptions, technical errors, or data loss. You assume all risks associated with your use of the Platform. Our total liability to you shall not exceed the amount you paid to us in the past twelve (12) months.

10. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless 1UP Esports, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the Platform, your violation of these Terms, or your violation of any third-party rights.

11. TERMINATION AND SUSPENSION

We may terminate or suspend your Account and access to the Platform immediately, without prior notice or liability, for any reason, including a breach of these Terms. Grounds for termination include, but are not limited to, cheating, harassment, and illegal activity.

Upon termination, your right to use the Platform will immediately cease. Provisions of these Terms which by their nature should survive termination shall survive, including IP rights, warranty disclaimers, indemnity, and limitations of liability. You may appeal a suspension or termination by contacting our support team.

12. DISPUTE RESOLUTION AND GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

Any dispute arising from these Terms or the Platform shall first be attempted to be resolved informally by contacting us. If informal resolution fails, disputes shall be resolved through binding arbitration in London, UK. You waive any right to a jury trial or to participate in a class action lawsuit.

13. MODIFICATIONS TO TERMS

We reserve the right to modify or replace these Terms at any time. We will provide notice of significant changes by posting the updated Terms on the Platform and updating the "Last Updated" date. Your continued use of the Platform following the posting of any changes constitutes acceptance of those changes.
